Doing the math, at level 38 plus all places of power and the acorn, you will end up with 64 ability points. You'll be about level 34 after the main questline and about level 38 after HoS.
You get 25 ability points from all of the places of power and 2 points from the acorn. To upgrade a skill already slotted you can either follow the normal rules for the skill pane, or select the slotted skill and "Space" to add one more skill point to it. Max is relative as it is dependent upon your level. You can now assign the skill (or mutagen) by pressing "Space", then highlighting (again keys or mouse) the desired slot and pressing "E". This also works for upgrading an existing skill whether applied or not. To add a point to a *new* skill, select the skill (using either arrow keys or mouse) and press "E" to give it a new point.
